The parent company of the right-wing channel was also named in the lawsuit. Fox Corporation has argued that Dominion overstated its role in Fox News’ editorial coverage of the 2020 election and asked to be dropped from the lawsuit – but the judge let the case move forward.

It is part of the process of haggling over witnesses while both sides prepare for trial, and they will face legal challenges from Fox’s lawyers.

Dominion previously asked Delaware Superior Court Judge Eric Davis to force Fox Corporation Chairman Rupert Murdoch and chief executive Lachlan Murdoch to testify at trial, as well as board member Paul Ryan, the former House speaker. Davis isn’t sure what witnesses he’d like to compel to take the stand.

The judge was asked to proclaim Fox News the winner without a trial. The judge has yet to rule on the matter, but most legal experts believe the case will ultimately proceed to a jury trial if the two sides do not reach a settlement. Jury selection is scheduled to begin on April 13.

Both sides hope to get testimony from their experts who are experts in election statistics, security of voting machines, and more.

It would be impossible for the software to flip millions of votes between Biden and Trump, as many Fox hosts and guests have suggested.

The voting technology company publicly released the full slideshow Wednesday, per a court order. Fox News accused the right-wing network of cherry picking emails to present a self-serving narrative about what they did after the election.

A Fox spokesman said in a statement, “These documents once again demonstrate the reliance on cherry-picked quotes without context to generate headlines and distract from the facts of this case.” We will fight for the First Amendment and the right to cover the news even though it is at stake.

Scott wrote an email to Dana Perino in November 2020, zinging her for her “dismissive tone” in the presidential contest, and he discovered 25k subs had been lost from its streaming service.

The messages underscore the panic that gripped Fox News in the wake of the 2020 election when its viewers rebelled against the channel for accurately calling the election for President Joe Biden.

Other newly released emails showed network producers discussing how putting Trump lawyers Rudy Giuliani and Sidney Powell on the air inflated ratings. Powell, Giuliani and Dobbs promoted a conspiracy theory that Dominion rigged the 2020 election to get millions of people to vote.

“Any day with Rudy and Sidney is guaranteed gold!” the Dobbs producer wrote. In an email, another producer said they really needed Rudy or Sidney to keep this going.
