Subpoena Requests from the House Select Committee on the Ethics and Prosecutive Ethics of the U.S. President Donald Trump

In a statement Friday, the House select committee gave Trump more time to turn over the documents it had subpoenaed, but gave no explanation as to why the extension was granted.

The committee also said it “received correspondence from the former President and his counsel in connection with the Select Committee’s subpoena” but did not provide additional information.

The former president’s legal team is working with other members of the Trump team to determine how to proceed with the committee’s subpoena demands.

Republican Rep. Liz Cheney of Wyoming, the vice chairwoman of the committee, previously said the committee was “in discussions” with Trump’s attorneys about testifying under oath in the probe. But it remains unclear whether those discussions will lead to him sitting for a deposition.

The broad document request even asked for all documents and communications relating or referring “in any way” to members of the Oath Keepers, the Proud Boys, or other extremist groups from September 1, 2020, to the present. The panel’s document request spans 19 different categories.

CNN has learned that Jack Smith, the newly appointed special counsel, is working fast on a pair of criminal probes around Donald Trump that in recent months have focused on the former president and his state of mind after the 2020 election.

Together, the twin investigations have already established more evidence than what Mueller started with, including from a year-long financial probe that’s largely flown under the radar.

The source said that it was a good thing that they found a guy who has been Europe for the past several years, without his brain being thrown in the January 6th coverage.

People familiar with their thinking say Smith is seen as a “hit man” by some on Trump’s team who think that he is likely to bring a prosecution.

The Justice Department took a small step back in their approach in the Mar-a-Lago case after a judge refused to hold Trump in contempt and investigators worked to make sure all national security records were back.

“It could well be that Jack Smith moves more quickly than Merrick Garland would and forces a decision to Merrick Garland’s desk more quickly than it might have otherwise,” said Honig.

According to a handful of people familiar with the probe, there is still work to be done to centralize all the moving parts of large prosecution teams under the new special counsel’s office.

Smith is expected to set up a physical office for the two investigative teams away from the downtown Justice headquarters, as Mueller did for his probe and as did John Durham, who is nearing the end of his examination of 2016 Trump-Russia investigation.

Garland turned to Patty Stemler, who retired from the DOJ earlier this month, to be a consultant on the January 6 investigations.

Others from Stemler’s former unit and other sections are likely to shepherd cases and policy issues as needed, in a departure from Mueller’s soup-to-nuts approach of preparing for thorny Constitutional issues and appeals in the Russia investigation, some of the sources said.

The DOJ Grand Jury Investigation of Donald Trump’s 2016 January 6 riot and 2021 campaign: Sources say the case for false voter registration is not related to the 2020 election

The DOJ has added prosecutors to the January 6 team from all over the department in recent months, led by Thomas Windom, a former Maryland federal prosecutor. Windom and the rest are also expected to move over to the special counsel’s office. Mary Dohrmann, a prosecutor who has worked on a number of Capitol riot cases, appears to be reorienting, according to court records.

Another top prosecutor, JP Cooney, the former head of public corruption in the DC US Attorney’s Office, is overseeing a significant financial probe that Smith will take on. Some sources say that the probe includes looking at the misuse of political contributions. There were potential financial crimes that could have been committed during the January 6 riot, including money laundered, and the DC US Attorney’s Office had looked into it before the special counsel arrived.

The financial investigation has been looking into Trump’s post- election Save America campaign, and the people who helped him, according to subpoenas viewed by CNN. The financial investigation picked up steam after the 2021 riot as DOJ investigators enlisted cooperators, one of the sources said.

A source with knowledge of the questioning says that the DOJ focus has been on the timeline prior to January 6 and Trump’s involvement and knowledge of potential events that day.

Trump allies have consistently maintained that nothing Trump did related to the election and January 6 itself amounts to a crime. The bar to prove a crime is extremely high if you are going to face an indictment and a jury would hear conflicting advice from different lawyers. Trump allies point out that White House Counsel Pat Cipollone told Trump that the vice president could not stop the certification of the election, while others believed he could.

Efforts were made to get pro- Trump electors involved and to file baseless lawsuits. CNN reported this summer that the DOJ subpoenaed information in all seven states where false electors were convened as part of the efforts to subvert the Electoral College.
