The Fox News Case: Investigating the Truth About a Colorado-Based Voting Machine Manufacturer in the Wake of a Democratic Republican Congressional Majority

Conservative TV darlings Tucker Carlson, Sean Hannity and a slew of other Fox News stars and executives, including the network’s 92-year-old owner Rupert Murdoch, may soon have their days in court in what stands to be the biggest media trial since the 1980s.

In the weeks after the 2020 election, Fox News defaming a Colorado-based voting machines maker irreparably damaged its business.

The network’s ratings were said to have been saved by the hosts and executives acting with reckless disregard for the truth about the voting machines. Fox News was the first network to call the state of Arizona for Biden on election night, but their audience numbers fell as a result. Many of its viewers were Trump supporters.

The First Amendment protects the right of guests to say what they want, even if it doesn’t feel right, according to attorneys for Fox.

The case is a meritless assault on press freedoms, Fox has denied wrongdoing. Lawyers for Fox have argued that Dominion hasn’t come close to clearing the high bar to prove defamation.

That high standard is known as “actual malice.” It’s meant to protect media outlets from being punished for reporting critically on powerful figures, including corporations and the government.

Delaware Superior Court Judge Eric Davis said there’s no question that the statements Fox aired were false.

Text messages and email exchanges show that Fox personalities knew their hosts were lying when they called them out on air.

Two of those guests were Rudy Giuliani, Trump’s personal lawyer at the time, and Sidney Powell, a Trump ally and attorney. (Dominion has separately sued both Giuliani and Powell but there have been no rulings in either of those cases.)

“The whole thing seems insane to me, and Sidney Powell won’t release the evidence. Which I hate,” Carlson texted fellow hosts Hannity and Laura Ingraham a couple weeks after the election.

Asked by a Dominion attorney under oath whether or not he could have directed Scott to stop hosting Powell and Giuliani on Fox, Murdoch answered that he could have.

The network’s attorneys claimed that the company’s worth was not close to what the court had been told.

According to the lawsuit, all 20 statements took place between November 8, 2020, and January 26, 2021, and came in the form of on-air comments from Fox hosts Jeanine Pirro, Lou Dobbs and Maria Bartiromo; interviews with prominent pro-Trump election deniers Sidney Powell, Rudy Giuliani and Mike Lindell; and several of Dobbs’ tweets.

“Well, I can hardly wait to put forth all the evidence we have collected on Dominion, starting with the fact it was created to produce altered voting results in Venezuela for Hugo Chavez and then shipped internationally to manipulate votes for purchase in other countries, including this one,” Powell said.

It is blatantly clear that none of the statements about the 2020 election of Dominion are true according to the judge overseeing the defamation trial.

At trial, it will be a jury’s job to determine if the statements were made with “actual malice” – a high bar based on knowing falseness or having a reckless disregard for the truth – and potentially award damages. Fox says the number is wildly overblown, despite the fact that the company has asked for $1.6 billion in damages.

“That’s to put it mildly. Powell said the computer glitch could not have happened. “That is where the fraud took place where they were flipping votes in the computer system or adding votes that did not exist.”

“We also need to look at and we’re beginning to collect evidence on the financial interests of some of the governors and Secretaries of State who actually bought into the Dominion Systems … to line their own pockets by getting a voting machine in that would either make sure their election was successful or they got money for their family from it,” she added.

A large, criminal conspiracy that has been exported by a US citizen should be investigated by military intelligence for its national security implications.

“Give us your sense of who is driving all of this,” Dobbs asked Phil Waldron, a Trump supporter who worked with Powell and others to spread conspiracy theories about the 2020 election.
